ArtfulChat ("we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered creative platform ("the Service"). By using the Service, you consent to the data practices described in this policy.

2. Information We Collect

2.1 Account Information

When you create an account, we collect your email address, display name, and authentication credentials. If you sign up via a third-party provider (such as Google or GitHub), we receive your name, email, and profile picture from that provider.

2.2 Payment Information

All payment processing is handled by Stripe, our third-party payment processor. We do not store your full credit card number, CVV, or other sensitive payment details on our servers. We retain your Stripe customer ID and subscription status for account management purposes.

2.3 Generated Content

We store the images, videos, and other media you generate using the Service, along with the prompts and parameters used to create them. This content is stored within your account's storage allocation and is necessary to provide the Service.

2.4 Voice Data

When you use the GROK-powered voice chat feature, audio data is streamed in real-time to our AI service provider for processing. We do not permanently store voice recordings. Voice interactions are processed in real-time and are not retained after the session ends, except for usage metadata (duration and credit consumption).

2.5 Usage Data

We automatically collect information about how you interact with the Service, including: features used, credit consumption, session duration, device type, browser type, IP address, and general location data (country/region level). This data helps us improve the Service and troubleshoot issues.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process your subscription and manage billing
  • Track credit usage and enforce plan limits
  • Store and deliver your generated content
  • Communicate with you about your account, including service updates and billing notifications
  • Detect, prevent, and address technical issues and security threats
  • Enforce our Terms of Service and Acceptable Use Policy
  • Monitor for violations, including the generation of prohibited content
  • Comply with legal obligations and respond to law enforcement requests

4. Content Moderation and Safety

We employ automated content moderation systems to detect content that violates our Terms of Service. Generated content may be reviewed by automated systems and, in some cases, by human moderators. If content is flagged as violating our policies, we may take action including removing the content, suspending or terminating the account, and where legally required or appropriate, reporting the content and associated account information to law enforcement authorities.

Content flagged for severe violations (such as CSAM or terrorism-related material) may be preserved and disclosed to law enforcement even after account termination.

5. How We Share Your Information

We may share your information in the following circumstances:

  • Service Providers: We share data with third-party service providers who help us operate the Service, including Stripe (payment processing), Supabase (database and authentication), and xAI (AI model inference for image/video generation and voice chat).
  • Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Law Enforcement: As described in our Terms of Service, we will report severe content violations to the appropriate law enforcement authorities, including all relevant account information and generated content.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information to third parties. We do not share your generated content with third parties for their marketing purposes.

6. Data Storage and Security

Your data is stored securely using industry-standard encryption and access controls. Generated content is stored in cloud storage with access restricted to your account. We implement technical and organizational measures to protect your data, including encryption in transit (TLS) and at rest, regular security audits, and access logging.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

7. Data Retention

We retain your information as follows:

  • Account data: Retained for as long as your account is active, plus 30 days after deletion to allow for account recovery.
  • Generated content: Retained while your account is active. Deleted within 30 days of account termination or upon your request.
  • Billing records: Retained for a minimum of 7 years as required for financial and tax compliance.
  • Usage logs: Retained for up to 12 months for service improvement and security purposes.
  • Violation records: Records of Terms of Service violations may be retained indefinitely for safety and legal compliance purposes.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate personal information
  • Request deletion of your personal information (subject to legal retention requirements)
  • Object to or restrict processing of your personal information
  • Request a portable copy of your data
  • Withdraw consent where processing is based on consent

9. Children's Privacy

The Service is not intended for users under the age of 18. We do not knowingly collect personal information from children under 18. If you believe a child under 18 has provided us with personal information, please contact us immediately and we will take steps to delete such information.

10. Third-Party Services

Our Service integrates with third-party services that have their own privacy policies. These include:

  • Stripe — Payment processing. See Stripe's Privacy Policy
  • Supabase — Database and authentication infrastructure
  • xAI — AI model provider for image generation, video generation, and voice processing

11. Cookies and Tracking

We use essential cookies to maintain your authentication session and provide core functionality. We do not use third-party advertising cookies or tracking pixels. Session cookies are deleted when you close your browser; persistent cookies (such as authentication tokens) are retained until you sign out or they expire.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or through a prominent notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated policy.
