By accessing or using ArtfulChat ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and ArtfulChat ("we", "us", or "our").
ArtfulChat is an AI-powered creative platform that enables users to generate, edit, and extend images and videos using artificial intelligence, as well as interact via voice-powered AI chat. The Service includes image generation, image editing, video generation, video editing, video extension, and GROK-powered voice interaction.
ArtfulChat offers three subscription tiers: Basic ($9.99/month), Pro ($29/month), and Enterprise ($79/month). Each plan includes a monthly credit allocation and access to features as described on our pricing page. Annual billing is available at a discounted rate of approximately 20% off monthly pricing.
All subscription plans include a 3-day free trial with 33 credits. During the trial, you have full access to the features of your selected plan but are limited to 33 credits. Your payment method will be charged at the end of the trial period unless you cancel before the trial expires, at which point your full monthly credit allocation begins. You may only use one free trial per account.
ArtfulChat uses three types of credits, each with distinct lifecycle rules:
Credits are consumed when you perform operations such as generating images (2 credits per image), editing images (2 credits per image), animating videos (1-2 credits per second based on resolution), editing videos (1-2 credits per second based on resolution), extending videos (3 credits overhead plus per-second generation cost), and voice chat (1 credit per minute). Image enhancement is provided at no credit cost.
When credits are deducted, the system uses the following priority order: CCP credits first, then subscription credits, then purchased credits. This ensures expiring credits are consumed before non-expiring ones. Refunded credits are returned to your purchased credit balance.
Due to the nature of AI-generated digital content, all sales are final and no refunds will be issued for any subscription payments, including partial billing periods, unused credits, or plan downgrades. By subscribing, you acknowledge that AI-generated content is consumed immediately upon creation and cannot be "returned." If you cancel your subscription, you will retain access to your plan's features until the end of the current billing period.
You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately and you will be charged a prorated amount. Downgrades take effect at the start of your next billing period. Cancellations will leave your account active until the end of the current billing period, after which your account will revert to the Basic tier without an active subscription.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to generate, edit, or distribute content that:
If we determine, in our sole discretion, that you have violated the Acceptable Use Policy, your account may be terminated immediately without prior notice and without refund. This includes the permanent deletion of your account, all generated content, and any associated data.
For severe violations, including but not limited to the creation of child sexual abuse material, content depicting real-world violence, terrorism-related material, or any content that constitutes a criminal offense, we will report the violation and all relevant account information to the appropriate law enforcement authorities. We cooperate fully with law enforcement investigations and may preserve and disclose any information (including account details, IP addresses, usage logs, and generated content) as required by law or as we deem reasonably necessary to protect the safety of any person.
We reserve the right, but are not obligated, to monitor, review, and remove any content generated through the Service. We employ automated systems and human review to detect violations of these Terms.
Content that violates our policies is subject to a progressive enforcement system:
Free-tier accounts are subject to additional content moderation. NSFW content generated by free-tier users will be automatically reviewed and may be replaced with a placeholder image. Upgrading to a paid plan (Basic, Pro, or Enterprise) removes these content restrictions.
If you believe your account was suspended or frozen in error, you may file an appeal on our Discord server. Appeals are reviewed by our team and decisions are made at our sole discretion. Filing an appeal does not guarantee reinstatement of your account.
Subject to compliance with these Terms, you retain ownership of the content you create using the Service. You grant ArtfulChat a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of operating and providing the Service.
ArtfulChat, its logo, and all related software, technology, and intellectual property are owned by ArtfulChat. Nothing in these Terms grants you any rights to our trademarks, service marks, or brand assets.
Each subscription plan includes a storage allocation: Basic (100 MB), Pro (1 GB), and Enterprise (2 GB). If you exceed your storage limit, you will be unable to create new content until you delete existing content or upgrade your plan. Upon account termination or cancellation, your stored content may be deleted after 30 days.
API access is not currently available on any subscription plan. We reserve the right to introduce API access in the future under separate terms and pricing.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your expectations. AI-generated content may occasionally produce unexpected or imperfect results.
To the maximum extent permitted by law, ArtfulChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
